FREEMAN & SEAR ONLINE AUCTIONS: TERMS AND CONDITIONS

This is an online auction sale conducted by Freeman & Sear. By participating in this auction, all bidders agree to accept the following terms of sale.


1. Registration: All online bidders must be registered on the Freeman & Sear website. To register, click on the Account Login button on the banner and complete the Create a New Account form.

2. Bidding: Bidders may submit bids in two ways: (a) By entering the next incremental bid as indicated on the lot; or (b) by entering any amount higher than the next bid indicated, i.e. a 'bid limit.'  Freeman and Sear's proxy bidding system allows for the entry of a bid limit, the level of which will be reduced automatically to that of the minimum incremental increase required to exceed the bids of other participants. By way of illustration, if the next required bid level on a lot is $500, instead of bidding this figure, you may choose to enter a bid limit of $1,000. Your bid will be displayed at only $500, and you will be awarded the lot at this level should no higher bids be received. However, if another bidder places a bid of $525, the proxy program will raise your bid to $550 and will continue to raise it, as competition dictates, to your $1,000 bid limit. Under no circumstance will your maximum bid on a lot be revealed to other bidders. You will be notified by email each time your bid is increased or in the event your bid limit has been exceeded. You may increase your bid anytime prior to the close of the auction.

Your bid will be shown as the current high bid on the lot until you are outbid. The status of your bids will be displayed each time you use the Account Login function of the site. If you are outbid, you will receive an email notification with a link back to the auction. Your name, user ID and email address information is kept confidential and will not be made available to other bidders.

Note: As the site does not automatically refresh, it is necessary to hit the "refresh" or "reload" button on your web browser to keep current on bid levels. We advise not to wait until the last possible moment to bid, as bidding will close at precisely the time posted on each lot.

If you prefer not to enter online bids directly, you may contact Freeman & Sear via phone at (310) 450-9755 and have us enter proxy bids on your behalf. Please bid early if employing this option, as it may prove difficult to contact us directly in the closing hours of the sale.

4. Corrections / Retractions: If you bid on an incorrect lot or otherwise make a mistake in bidding, please contact Freeman & Sear via phone or email us immediately, and we will correct your bid. It is not possible to alter a bid without our assistance.

5. Good faith: Freeman & Sear reserves the right to reject and delete any bid that it determines not to be made in good faith or in instances where the bidder has not established proper credit.

6. Buyer's fee: Freeman & Sear currently charges NO BUYER’S FEE in the online auction format.

7. Returns: All items are unconditionally guaranteed genuine. Grading and adjectival descriptions are subjective and in no way express or imply warranty. Please note that an online auction is not an approval sale. Lots may be returned only for reasons of authenticity or misdescription. All claims of misdescription (excluding issues of authenticity) must be submitted to Freeman & Sear within five (5) days of receipt of the auction lot or lots. If payment is made by credit card, the terms concerning returns stated here take priority over those established by the credit card companies.

8. Payments: All sales are for cash payable in United States dollars drawn on a U.S. bank. Payment may be made via credit card (Visa, MasterCard or Discover), check, or direct wire transfer to our bank account at:

Payment is due immediately upon the notification of a successful bid at the close of the auction. If a bidder already has authorized payment by credit card and has provided credit card details, the card will be charged for the applicable amount upon close of the auction. If no credit card information was provided prior to the close of the auction, successful bidders may initiate a credit card payment by clicking on “Pay Now” on the customer page and completing the checkout process. If payment by check or bank wire is preferred, an invoice will be emailed to the client for payment. All checks and/or credit cards from clients unknown to Freeman & Sear may require additional verification. Interest charges will accrue in the amount of 2% per month beginning 30 days after the auction close. Freeman & Sear reserves the right to cancel any prevailing bids submitted by clients who have grossly exceeded the time limit for payment in previous electronic auctions. In such instances, lots will be awarded to the underbidders.

9. Sales Tax: Lots purchased and delivered in the State of California are subject to sales tax if the total purchase is less than $1,000. However, total coin purchases of $1,000 or more are exempt from sales tax, as are purchases made by those who have filed a valid California resale permit with Freeman & Sear.

10. Postage fees:

    $5.00 USPS Insured mail for invoices totaling $200.00 and under
    $7.00 USPS Insured mail for invoices ranging from $200.01 to $300.00
    $15.00 USPS Insured Registered mail for invoices totaling $300.01 and over
    EXPEDITED OPTION: $35.00 for FedEx Priority Overnight

    OUTSIDE THE U.S.
    $15.00 USPS Insured Registered mail
    EXPEDITED OPTION: $65.00 for FedEx International Priority

All shipping methods described above are fully insured.

11. Lot viewing: Coins may be examined at our offices by appointment prior to the close of the sale. Coins also may be available for viewing at coin shows we attend during the course of the sale. Please consult the News & Events section of the website for information on upcoming coin shows and contact us to request that we bring the lots for viewing.
