TERMS OF SALE

Bidding in this a sale constitutes acceptance of the following terms and conditions:

1)         Bids may be submitted by post, telephone and fax. Written confirmation of telephone bids is required. ALL BIDS MUST BE RECEIVED BY 5:00 P.M. PDT ON THURSDAY, JUNE 21, 2007.

2)         Lots will be awarded to the highest bidder. In most instances, winning bids will be reduced to a level approximately 10% over the next highest bid. In the event identical bids are received, the lot will be sold to the earliest bidder. Freeman & Sear accept no responsibility for errors made in bidding and strongly suggest that bid sheets be checked carefully before submission.

3)         A BUYER’S PREMIUM OF 15% WILL BE ADDED TO THE HAMMER PRICE ON EACH LOT AND INCLUDED ON ALL INVOICES.

4)         Bidders unknown to us must establish satisfactory credit references before bidding and/or pay a deposit equivalent to 25% of the total of the bids submitted. Bids from those under eighteen (18) years of age must be accompanied by the written consent of a parent guaranteeing payment.

5)         We accept payment by check, money order, wire transfer, Visa, Mastercard, American Express and Discover. Checks and money orders should be in U.S. dollars only and made payable to Freeman & Sear. Residents outside the United States must also submit payment in U.S. dollars, i.e. checks drawn on a U.S. bank or, preferably, wired directly to our bank:

            All successful bidders who pay by wire transfer will be invoiced an additional fee for bank charges. Payment is due and payable immediately on receipt of invoice. Interest charges of 1.5% per month (18% per annum) will accrue if invoice is not paid within 30 days of the sale date. Title does not pass until lots are paid for in full.

            Lots purchased and delivered in the State of California are subject to sales tax. Total coin purchases at or exceeding ,000 (before buyer’s premium) are exempt from this tax, as are purchases made by those who have filed a valid California resale permit with Freeman & Sear.

6)         Postage, handling and insurance are at the expense of the buyer and all related charges will be added to the invoices for all lots delivered by mail. Foreign purchasers are advised to comply with all customs regulations. Freeman & Sear decline any responsibility for consequences arising from contravention of such regulations.

7)         Estimates in this catalog are in U.S. dollars.

BIDS BELOW 60% OF ESTIMATE CANNOT BE ACCEPTED UNDER ANY CIRCUMSTANCE.

8)         All coins are guaranteed genuine and as described. Grading and adjectival descriptions are subjective and in no way express or imply warranty. Please note that this mail bid sale is not an approval sale. Lots may be returned only for reasons of authenticity and misdescription, and then, only if they are returned in precisely the same condition as when shipped by Freeman & Sear. All claims of misdescription (excluding claims regarding authenticity) must be made within five (5) days of delivery of the material. ALL LITERATURE LOTS, AS WELL AS ALL MULTIPLE COIN LOTS (OF TWO ITEMS OR MORE), ARE SOLD AS IS AND MAY NOT BE RETURNED FOR ANY REASON.
